2. Personal Data
2.1 Safeday processes your personal data because you use our services and/or because you provide this data to us. To provide the product services, we need the personal data requested/mentioned in the online form, including your name and contact details. Depending on the nature of our service, additional personal data may be required.
2.2 Safeday does not process any special and/or sensitive personal data about you.
2.3 Our website and/or service does not intend to collect data about website visitors who are under the age of 16, unless they have permission from a parent or guardian. However, we cannot always verify whether a visitor or user is over the age of 16. We therefore recommend that parents be involved in their children's online activities, in order to prevent the collection of data about children without parental consent. 3. Legal Basis
3.1 By filling in your contact details on the Safeday website or Safeday applications, you consent to the processing of the personal data you have provided, in line with this privacy statement. This forms the legal basis for us to process your data. Additionally, we also process your personal data in order to fulfill agreements we have made with third parties, for example your employer.
3.2. Your personal data will only be processed for the purposes described in this privacy statement.
4. Purpose
The purpose of collecting your personal data is to identify you within the Safeday platform and to link your information to the activities you complete, such as trainings, tests, access requests, or other workflow steps. This enables Safeday, and the clients who use our platform, to determine who has completed required steps and to take appropriate follow-up actions. In addition to learning tools, Safeday also provides an access portal. For this functionality, your data may be shared with connected access control systems that operate hardware (such as gates or door controllers) in order to grant or deny access to specific sites or areas.
5. Recipients
5.1 As part of offering our software as a service (Software as a Service - SaaS), your personal data will be shared with third parties. These include our clients and their related partners who use our services. Your personal data will not be used or deployed for marketing purposes.
5.2 For our business operations, it may also be necessary to share personal data with our own partners and service providers, such as IT suppliers or technicians. This information is shared solely on a "need-to-know" basis.
5.3 Personal data may also be shared if Safeday believes this is necessary to comply with applicable laws and regulations, legal proceedings, or requests from governmental authorities.
5.4 We enter into data processing agreements with companies that process your data on our behalf to ensure the same level of security and confidentiality.
5.6 When an organization invites you to join its Safeday environment and you accept this invitation, that organization will gain access to the personal data you provided during onboarding in Safeday, including your first name, last name, and date of birth. This information is used for managing your account, trainings, certifications, access rights, and other activities within the relevant Safeday environment.
5.7 An organization may enroll you through Safeday in a training course, examination, or certification program provided by an external training provider or certification body. In such cases, only the personal data necessary for your registration, participation in the activity, and the registration or issuance of a certificate will be shared. This will generally include your first name, last name, and date of birth. The external party will not receive access to any other training results, certificates, or personal data stored within Safeday.
5.8 If you no longer wish an organization to have access to your personal data within its Safeday environment, you may request removal from that environment by contacting the administrator of the relevant organization. Once removed, that organization will no longer have access to your data within its Safeday environment and will no longer be able to enroll you through Safeday in training courses provided by external parties.
6. Consequences of Not Providing Data
If you wish to use Safeday's software, you must provide your personal data. If you do not, Safeday will not be able to identify who has completed the onboarding, access request, relevant course, test, or learning tool. As a result, this information cannot be relayed to our client, and the outcome or intended effect of following the learning material, test, or course may not be achieved.
7. Automated Decision-Making
Safeday uses automated results for tests and learning modules (for example: “passed” or “failed”). However, these outcomes do not lead to fully automated decision-making. A human, such as an administrator, trainer, or gate employee, can always review the result and override it, for example by issuing a certificate even if the system marked the result as failed.
8. Retention Period
Safeday does not retain your personal data longer than is strictly necessary to achieve the purposes for which it was collected, or to meet our business and legal obligations. In some cases, your employer or the organization that manages your account within Safeday determines how long your data remains active in our system. They are responsible for managing user accounts and may choose to deactivate or delete them according to their own retention policies.
9. Security
Safeday takes the protection of your data seriously and implements appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modification. If you believe that your data is not properly secured or if there are indications of misuse, please contact us.
10. Your Rights
You have the right to request access to, correction of, restriction of, or deletion of your personal data, as well as to object to certain processing activities, in accordance with applicable data protection laws.
Safeday accounts can only be created following an invitation from an organization that uses the Safeday platform. In most cases, this organization acts as the controller of your personal data and determines the purposes for which your data is processed.
If you wish to exercise any of your privacy rights, including requests for access, correction, or deletion of your personal data, you should contact the organization that invited you to Safeday. That organization is responsible for assessing and handling your request. Where required, Safeday will assist the relevant organization in fulfilling its obligations under applicable data protection laws and may take action on the organization's instructions.
11. Cookies
Safeday uses only technical and functional cookies and analytical cookies that do not infringe on your privacy. The cookies we use are necessary for the technical operation of the website and for your ease of use. They ensure that the application works properly and remember your preferences, for example.
12. Use of Anonymised Data
Safeday may process your personal data into anonymised information. Anonymised data is data that can no longer be traced back to an individual user in any way and is therefore not considered personal data under the GDPR. We use anonymised data to improve our platform, develop new functionalities, analyse trends, generate safety or compliance insights, and for statistical or research purposes. Safeday may also share or sell anonymised datasets to third parties, such as clients, partners, or industry stakeholders. These datasets will never contain information that identifies you as an individual or could be used to trace the data back to you. The anonymisation process is designed in such a way that your personal identity is permanently removed and cannot be reconstructed by Safeday or any third party.
